Purpose: BaguetteWeb.com showcases services in website creation, SEO optimization, and visual content for tourism professionals and local businesses in Hawaii. By using this website, you agree to these Terms of Use and the Privacy Policy below.


2. Contract & Agreement

Before any project begins, a digital or written contract is signed. This agreement defines scope, deliverables, timeline, payment terms, and responsibilities.

a) Project Validation
Work starts only after:

  • Client approval of the written quote/proposal, and

  • Receipt of the 30% deposit.

b) Modifications (Out-of-Scope)
Any change in scope (new pages/features, extra revisions beyond the agreed limit) requires a written addendum and may affect cost and delivery time.

c) Ownership & Delivery
All files and deliverables remain property of BaguetteWeb until full payment. After settlement, ownership transfers to the client (excluding third-party licenses such as Elementor Pro, RankMath, LatePoint, stock assets, etc., which remain under their vendor licenses).

d) Signature & Legal Validity
Email confirmation or e-signature on the estimate/contract is deemed legally binding under U.S. and international e-signature laws.


3. Services & Payment Terms

All projects are subject to a written estimate and a signed agreement.

a) Payment Schedule (30/30/40)

  • 30% deposit to confirm and start the project (non-refundable),

  • 30% upon design approval (layout/structure/key pages validated),

  • 40% upon final delivery (before migration or public launch).

Payments via bank transfer, Stripe, or Wave invoice (secure link).

b) Late Payments
Any delay exceeding 10 days may suspend the project until payment. Site launch/transfer occurs only after full balance is cleared.

c) Refunds & Cancellation
No refunds once production has started (custom work). If canceled mid-project, completed work remains BaguetteWeb’s property until all due payments are settled. The 30% deposit covers planning, setup, and blocked production time.


4. Monthly Maintenance & Hosting Plan ($49/month)

To keep client websites fast, secure, and up to date, BaguetteWeb provides a monthly maintenance & hosting service at $49/month.
This plan is mandatory for sites hosted & managed by BaguetteWeb, unless otherwise agreed in writing.

a) Services Included

  • Premium hosting & uptime monitoring

  • WordPress/core/plugin updates (incl. licensed tools where applicable)

  • Daily backups & security scans (Wordfence, UpdraftPlus)

  • Performance optimization (cache, images)

  • Basic SEO monitoring

  • Customer support for minor technical questions

This plan keeps your site safe, up to date, and fully functional.

b) Payment & Billing

  • Billed monthly ($49) or annually ($529).

  • Payment via Wave or Stripe subscription.

  • First payment due at website delivery/activation; subsequent payments every 30 days.

  • Annual option must be paid in full before coverage begins.

c) Late or Missed Payments

  • Services may be suspended after 10 days past due.

  • Hosting may pause after 30 days of non-payment.

  • After 45 days without payment, the site may be disabled/removed following written notice.

d) Cancellation

  • Cancel with 30 days’ written notice (email).

  • BaguetteWeb provides a full backup and reasonable migration assistance.

  • Developer-provided licenses (e.g., Elementor Pro, RankMath Pro) are deactivated unless the client purchases their own.

  • After migration/cancellation, BaguetteWeb is not responsible for performance, updates, or security.

e) Renewal & Price Changes

  • Renews automatically monthly unless canceled in writing.

  • Pricing may adjust annually; 30-day prior notice provided.

f) Support Limitations
Covers technical upkeep only. New pages, redesigns, advanced features, content work, or SEO campaigns are quoted separately.


5. Services & Responsibilities

BaguetteWeb Responsibilities

  • Deliver functional, optimized, responsive websites.

  • Provide guidance on content integration and SEO best practices.

  • Deliver in accordance with the signed agreement and milestones.

Client Responsibilities

  • Provide accurate content (texts, photos, business info) on time.

  • Approve phases (structure, design, content) without undue delay.

  • Ensure legal compliance and copyrights for submitted materials.

Limitations of Liability
BaguetteWeb is not liable for: hosting outages/third-party updates, issues caused by external plugins or client changes post-delivery, or data loss due to client/hosting incidents. Ongoing maintenance post-delivery is the client’s responsibility unless subscribed to the maintenance plan.


6. Privacy Policy

We respect your privacy and protect your personal data.

a) Information We Collect

  • Name, email, message (contact form/Calendly)

  • Business details (for quotes/services)

  • Technical data: cookies, device, IP (Google Analytics/Site Kit)

We do not collect sensitive personal data.

b) How We Use Your Data

  • Communicate and prepare quotes

  • Manage projects and client communication

  • Improve website performance & UX

  • Anonymous analytics
    We never sell or rent personal data.

c) Cookies
Used for analytics and core functionality. You can disable cookies in your browser settings.

d) Third-Party Tools
Google Analytics / Site Kit, Calendly, Wave, Wordfence, UpdraftPlus (each with its own privacy policy).

e) Data Retention

  • Contact form data: up to 12 months, unless you become a client.

  • Client/project/billing data: retained per accounting/legal obligations.
